Act No. 79-465 has no effect on Act No. 566 of 1976 Session regarding clerical assistants in the Office of Probate Judge of DeKalb County.

Dear Judge Thomas:

Reference is made to your request for an opinion from the Attorney General as to what effect Act No. 566 of the 1976 Legislative Session would have on Act No. 79-465 of the 1979 Legislative Session.

Act No. 566 states that the Probate Judge of DeKalb County shall designate from existing clerical positions one or more clerks in his office as deputy registrars who are to take applications for voting registration. These applications are then submitted to the Board of Registrars to be acted upon.

Act No. 79-465 amends Code of Alabama 1975, Section 17-4-25 and allows a probate judge to hire clerical assistants to prepare the list of qualified electors in the county which the probate judge is required to furnish for election inspectors.

It is the opinion of the Attorney General that these, acts are totally unrelated and have no effect on each other.

The clerical assistants which are appointed front the existing staff of the probate office pursuant to Act No. 566 of the 1976 Session are deputy registrars and take voter applications. Those employed as an addition to the staff of a probate office pursuant to Act No. 79-465 help in the preparation of the list of qualified voters. These two duties are not related and do not infringe upon each other.
