(a)
Any portion of the EMS used by county elections officials that is integrated with the statewide voter registration system shall be certified by the Secretary of State and shall adhere to all applicable federal and state laws.
(b)
In order for an EMS to be certified by the Secretary of State, the EMS vendor shall:
(1)
Submit an application on the California Application for Certification of an Election Management System (revised May 20, 2020; incorporated by reference).
(2)
Develop a plan and schedule, in collaboration with the Secretary of State, outlining the strategy to manage the EMS remediation and/or development (software development lifecycle).
(3)
Develop an EMS system, including system and security documentation that complies with the statewide voter registration system Integration Specifications, approved change requests, and the Data Standards.
(4)
Successfully complete all user acceptance testing (UAT) of their system with the Secretary of State and one of each certified EMS's contracted counties. UAT testing includes resolving all statewide voter registration system interface related defects identified through testing. If all defects cannot be resolved, then the EMS must identify and implement a mitigated workaround, which must be agreed to in writing by all parties, until the resolution of defects can be completed.
(5)
Successfully support system synchronization checks initiated by county elections officials and/or the Secretary of State and resolve differences, if any.
(6)
Enter into a contract with the Secretary of State for ongoing maintenance, operation, and system changes.
