(a)
The Hawaii election campaign fund shall be considered close to depletion when the balance in the trust fund equals the sum of the average amount of operating expenses, including staff salaries and fringe benefits, paid by the commission in the two prior fiscal years, added to the average amount of public funds paid by the commission to candidates in the partial public financing program in the two prior two-year election periods.
(b)
The Hawaii Election campaign fund shall be considered at near depletion when the balance in the trust fund equals the average amount of operating expenses, including staff salaries and fringe benefits, paid by the commission in the two prior fiscal years.
