Hawaii Regulations § 3-160-70 Complaints of violations; administrative fines; referral

(a)
Any complaint of a violation of the Hawaii election campaign laws in chapter
11
, part XIII, Hawaii Revised Statutes and this chapter, shall be filed with the commission.
(1)
A complaint shall be in writing and signed under oath by the complainant. The oath shall verify that the statements provided in the complaint were made with sufficient personal knowledge or information to form an understanding and belief that the statements are true. Complaints initiated by the commission or its staff shall be in writing and signed by the executive director;
(2)
The complaint shall provide specific and detailed statements that are based upon a complainant's personal knowledge and belief;
(3)
The complaint shall cite the statute or rule that has been violated, and allege facts to support the claim that a specific statute or rule has been violated; and
(4)
The complaint shall specify the remedy sought.
(b)
If a complaint does not comply with the requirements of this section, the commission staff shall notify the complainant and any persons identified in the complaint as respondents that no action shall be taken on the basis of that complaint.
