Hawaii Regulations § 3-161-41 Motion to dismiss

Up to Subchapter 2: Hearing Relief

Regulation Text

(a) After all evidence has been presented by the petitioner in support of the petition, the respondent may move the commission or the hearings officer for an order denying or dismissing the petition or for similar affirmative relief.
(b) If the motion is denied or taken under advisement, the respondent shall have the right to continue with the proceeding as fully as if the motion had never been made.
