Indiana Statutes § 3-11-8-11 Closing of polls; persons permitted to vote; extension of voting hours by order; provisional ballots
Statute Text
(a)
When the hour for closing the polls occurs, the precinct election board shall permit all voters who:
(1)
are waiting to announce their names to the poll clerks for the purpose of signing the poll list and have been identified using one (1) of the methods described in subsection (b);
(2)
have signed the poll list but who have not voted; or
(3)
are in the act of voting;
to vote.
(b)
At the time described in subsection (a), an individual precinct election official designated by the county election board shall:
(1)
determine the end of the line of voters who are waiting to vote; and
(2)
use one (1) of the following methods to identify the voters in the line who may vote if otherwise qualified to vote according to law:
(A)
Write down the name of each voter.
(B)
Stamp each voter's hand.
(C)
Stand, or designate another individual to stand, immediately behind the last voter who may vote.
(c)
This subsection applies if a court order (or other order) has been issued to extend the hours that the polls are open under section 8 of this chapter. As provided in
52 U.S.C.
21082
, the inspector shall identify the voters who would not otherwise be eligible to vote after the closing of the polls under subsection (a) and shall provide a provisional ballot to the voters in accordance with IC 3-11.7.
