Dear Ms. Poston:

You request the opinion of the Attorney General concerning K.S.A. 19-801b(a)(3), which states thus:

"No person shall be eligible for nomination, election or appointment to the office of sheriff unless such person shall possess and meet the following minimum qualifications:"

"(3) He must have been an actual, bona fide residence of and domiciled within the county for not less than twelve (12) months immediately preceding July 1 of the election year."

Under this provision, any person who seeks to declare himself a candidate for nomination and election to the office of sheriff must have been an actual legal resident of Harper County for not less than twelve months immediately preceding July 1, 1974, i.e., his residence in the county must have been commenced not later than July 1, 1973.
