Kentucky Statutes § 117.377 Acquisition or abandonment of voting equipment or voting system subject to approval of State Board of Elections - Petition in emergency situation

(1)
The legislative body of any county, urban-county government, charter county government, consolidated local government, or unified local government, may acquire by purchase or lease or lease-purchase agreement, or may abandon, any voting equipment or voting system covered by this chapter, if the voting equipment or voting system has been approved by the State Board of Elections. The legislative body shall notify the State Board of Elections that new voting equipment or a new voting system is being installed in the county.

The county clerk of any county may petition the State Board of Elections to allow new voting equipment or a new voting system in the county if an emergency exists. The petition must state the reasons why the present voting equipment or voting system is inadequate. Within sixty (60) days of the receipt of the petition the State Board of Elections shall notify the county clerk whether the permission to obtain new voting equipment or a new voting system is granted or denied. The letter of approval shall be presented to the legislative body for its approval before any new voting equipment or voting system is acquired.
