Re: Residency requirement for justice court judge
Dear Ms. Corbin:
Attorney General Mike Moore has received your letter of request and has assigned it to me for research and reply. You seek an official opinion of this office regarding the residency requirement for candidates seeking the office of justice court judge.
We have previously opined that candidates for the office of justice court judge must be lawful residents of the district they seek to serve. Section 250 of the Miss. const. of 1890 states that “qualified electors and no others shall be eligible for office.†If a candidate is a resident of one justice court district, he cannot be a qualified elector of another justice court district.
