Dear Mr. Parker:

Attorney General Edwin Lloyd Pittman has received your opinion request and has assigned it to me for research and reply. Your letter states as follows:

We would like to have your opinion about Code 23-5-35 relative to “obtaining money and goods under false pretense”. We had a voter disqualified because of a conviction of “receiving stolen goods”. Are they the same? Were we right in disallowing his voting rights?

While we are unable to render an official opinion on the action which the Commission has already taken, we can tell you that the two crimes mentioned in your letter are not the same. Furthermore, the crime of receiving stolen property is not otherwise included in the list of disqualifying crimes under Section 23-5-35, Miss. Code Ann. (1972).
