Advisory Opinion Text
Honorable Henry Clark
Secretary
Holmes County Election Commission
Route 1, Box 186
Pickens, Mississippi 39179
Dear Mr. Clark:
Attorney General Edwin Lloyd Pittman has received your letter of request and has assigned it to me for research and reply.
Your letter states:
“This is a request for a formal opinion on Mississippi statute addressing the validity of the mother, father, sister, brother, or first cousin of any candidate for public office serving as official poll worker during an election where such related candidate may or may not be lected.â€
Please see the enclosed copy of an opinion addressed to Honorable Charles G. Perkins, dated March 15, 1984.
In the Perkins opinion we stated that we know of no prohibition against a relative of a candidate in a primary election from serving as a member of the party executive committee which would conduct the election.
It therefore follows and is the opinion of this office that there is no prohibition against one serving as a poll worker in a special or general election in which any relative is a candidate.
As noted in the Perkins opinion we do not comment on the propriety of such service.
Very truly yours,
Edwin Lloyd Pittman, Attorney General.
