Dear Ms. Stevens:

Attorney General Edwin Lloyd Pittman has received your letter of request and has assigned it to me for research and reply. In your letter you state:

The Hazlehurst Separate School District which includes the municipality and added territory is planning on having a school bond election May 21, 1987. I, as Circuit Clerk, would like to know if the Circuit Clerk's Office will have to handle this election and also, if Copiah County is responsible for the costs of this election. I would also like to know who is responsible for handling the election as far as selecting the pollworkers and where polling places will be located. Your response is needed as soon as possible.

In response to your request you will please find attached hereto a copy of an opinion addressed to Mr. W.M. McMullan, dated September 24, 1986, and a copy of an opinion addressed to William T. May, dated November 14, 1986. As was stated in these opinions, when an election is conducted upon the issuance of school bonds as provided by § 37-59-11, the school board is obligated to pay the cost incurred in calling and conducting the election.

Pursuant to § 37-59-15 such election shall be held, as far as practicable, in the same manner as other elections. As to physically conducting the election and selecting the pollworkers for the election, this will be done by the municipal election commissioners as in any other municipal election.

Concerning the selection of polling places, pursuant to § 37-59-11 the school board has the authority and responsibility to designate the polling places at which such an election will be held.
