Dear Mr. Clarke:

Attorney General Edwin Lloyd Pittman has received your letter of request and has assigned it to me for research and reply. In your letter you ask two questions which will be addressed in order below.

QUESTION NO. 1:

Is the Election Commission obligated to use all of the workers that were used during the August Primary?

RESPONSE: No. The Election Commission is not obligated to use any of those persons who worked the polls during the August Primary.

QUESTION NO. 2:

If an election manager is publicly and openly supporting a candidate does this lead to:

a. Conflict of interest, and

b. Could this lead to a contested election?

RESPONSE: We know of no statutory provision which would prohibit a person from acting as an election manager who is publicly supporting a particular political candidate. Therefore, so long as the election manager abides by the law, there would seem to be no legal prohibition against such a person working as an election manager.
