Advisory Opinion Text
Honorable Mischael D. Cooke
Attorney for Tishomingo County Election Commission
Post Office Box 625
Iuka, Mississippi 38852
Dear Mr. Cooke:
Attorney General Edwin Lloyd Pittman has received your letter of request and has assigned it to me for research and reply. A copy of your request, and copies of two letters updating the information contained in your request are attached hereto and incorporated herein by reference.
It appears from your letter that the office of county surveyor and the name of the only qualified candidate for that office were added to at least two ballots and that such candidate received at least two votes at the November eleation. Under the circumstances, we are of the opinion that the election commission may properly certify such candidate as elected to the office.
Should you have any questions of if we may be of further assistance, please do not hesitate to contact this office.
Sincerely,
Edwin Lloyd Pittman, Attorney General
John H. Emfinger, Special Assistant Attorney General
