Dear Mrs. Mosley:

Attorney General Mike Moore has received your letter of request and has assigned it to me for research and reply. In your letter you ask:

The Election Commissioners of Wayne County and myself are in the process of complying with Section 23-15-159 Miss. Code 1972 Annotated, Special Pamphlet.

Many of our addresses are obsolete and we are expecting a lot of the letters mailed out to be returned unable to deliver. After the required time has passes, is it permissible to take these people off the voter rolls if the letter has been returned unable to deliver?

Pursuant to Miss. Code Ann. § 23-15-159 (Supp. 1987), so long as you have otherwise met the requirements of the statute and have mailed the appropriate notice to the ‘last known address', you may proceed to cancel the registration of such electors as provided by this statute.
