Dear Mr. Hyde:

Attorney General Bill Allain has received your letter of February 18, 1983, and has assigned it to me for reply. In your letter you state:

“As chairman of the Yalobusha County Election Commissioners, I have been requested to write for your official opinion to the following questions:

“Can a person who is presently serving on the Water Valley Consolidated School Board qualify as a candidate for the office of constable and still remain on the school board? If this same person does qualify and is elected to the office of constable can he remain on the school board?

“I would be very grateful if you would respond promptly to this request, as he is waiting on your response before qualifying.”

This office is not aware of any statute which would prohibit a county school board member from running for office as a constable or serving as a constable if elected, while also remaining a member of the school board, if he is able to fullfill the functions of both offices and render sufficient service to both positions of public trust.
