Dear Mr. Ward:

Attorney General Allain has received your letter of request and has assigned it to me for research and reply.

Your letter states:

“The Board of Supervisors has directed that I request your opinion on the following matter:

“Oktibbeha County has presubmitted a proposed redistricting plan to the Justice Department which has recently been rejected with respect to Supervisors' Districts. Does the Board of Supervisors have the power should they decide to do so, to forego holding the regular primaries and general elections of the Supervisors and constables, in the absence of an injunction issued by a court of competent jurisdiction?”

In response to your inquiry, we find no authority which would allow a board of supervisors to forego holding the regular primary and general elections of supervisors and constables absent an appropriate order issued by a court of competent jurisdiction.
