Dear Ms. Newman:

Attorney General Allain has received your letter of request and has assigned it to me for research and reply.

Your letter states:

“Please advise if it is all right for a person who votes in one precinct in their Beat in the county to work the polls in another precinct in that Beat.”

This office has previously said that since the statutes governing the conduct of party primaries do not address the manner of appointment of poll workers, Mississippi Code Annotated §§ 23-5-99 and -103 (Supp. 1982) are applicable to party primary elections as well as to regular or general elections.

We are enclosing copies of the aforementioned statutes which require that managers and clerks of elections be residents of the precinct in which the polling place they are to serve is located.

Section 23-5-105, a copy of which is also enclosed, provides for the appointment of bailiffs. It does not require that bailiffs be residents of the precinct in which the polling place they are to serve is located.
