Dear Mr. Humphrey:
Attorney General Edwin Lloyd Pittman has received your letter of request and has assigned it to me for research and reply.
Your letter states:
“As Secretary of the Pearl River County Democratic Executive Committee, we request an opinion on the following:
“Who is eligible to serve on the County Democratic Executive Committee? Can the wife, sister, husband, brother, daughter, son, father, mother, employee of a candidate serve on the County Democratic Executive Committee? If one of the above listed is elected at the Democratic caucus to serve on the County Democratic Executive Committee, is this permissible by law? Can a public official, if elected at the caucus, serve on the Committee?â€
In response to your inquiry, we know of no prohibition against any relative of a candidate serving on a county executive committee.
Furthermore, we know of no prohibition against a public official serving on said committee. However, please see the enclosed copy of an opinion addressed to Mr. Virgil Sellers, dated March 23, 1979. In summary, that opinion states that one may not serve on an executive committee and be a candidate in a primary election simultaneously.
