Dear Mr. Rogers:

Attorney General Pittman has received your opinion request and has assigned it to me for research and reply, your inquiry stating:

“The Stone County Election Commissioners have received a voter registration application from Mr. Oakley Bell, Route 3, Box 58, Lumberton, Ms. Mr. Bell is now a voter in Forrest County, but, due to personal reasons, would like to vote in Stone County. Mr. Bell lives on the Forrest-Stone County line. His home is located in Forrest County (280 feet from the county line) and his front yard is located in Stone County. Mr. Bell has homestead exemption in both Forrest and Stone Counties.

“We Election Commissioners request your legal opinion if we should approve Mr. Bell's application to vote in Stone County”

A person's front yard, although part of his residential property and of its curtilage, is not his county of residence for voting purposes. His county of residence for voting purposes is the county in which the living area of his residence is located.
