Dear Mr. Walters:

Attorney General Edwin Lloyd Pittman has received your letter of request dated September 19, 1984, and has assigned it to me for research and reply. In pertinent part, your letter states the following question:

“Lowndes County had a bond referendum June 6, 1984, for $6, 000, 000 for the County school system. The voters defeated this bond issue. My question is this: Is there a time limit as to when the County can have another bond election on the above? There has been some question as to a six months' period before this matter can be brought up again.”

After a review of the statutory provisions regarding the procedures for the calling of an election for the issuance of bonds, Sections 37-59-11 to 37-59-17 of the Mississippi Code of 1972, it appears that there is no statutory provision that requires a specified time period between the date of a defeated bond issue and the date that another election for the issuance of bonds may be held. However, the time period between the two elections must be sufficient to allow all statutory requirements to be met.
