Mississippi Attorney General Opinions

October 12, 1984

Mr. Charles F. Gottschalk

Secretary

Hancock County Election Commission

Post Office Box 249

Bay Saint Louis, Mississippi 39520

Dear Mr. Gottschalk:

Attorney General Edwin Lloyd Pittman has received your opinion request and has assigned it to me for research and reply, your letter stating:

The November 6, 1984 General Election Ballot will contain the names of four candidates for the position of School Board Member District #5.

Will a run-off election be required if no candidate receives a majority vote?

Section 37-5-9, Mississippi Code of 1972, copy attached, includes the language:

The candidate in each supervisor's district who receives the highest number of votes cast in the district shall be declared elected.

Therefore, a “run-off” would be neither required nor authorized.

Yours very truly,

Edwin Lloyd Pittman, Attorney General
