Attorney General Allain has received your letter of request dated September 25, 1981, and has assigned it to me for research and reply. Because of the length of your inquiry, a copy of it is attached as if Incorporated herein.
Since the matter you present is after-the-fact in nature, an opinion of this office can neither Validate nor invalidate the past actions of the school board, as only a court of competent jurisdiction could resolve the issues.
Therefore, we respectfully decline to address the constitu- tionality of the present election Procedure for cheerleaders.
However, if this office can be of benefit in the future, Please do not hesitate to contact us.
