Dear Mr. Gray:
Attorney General Bill Allain has received your opinion request dated June 3, 1983, and has assigned it to me for research and reply, your letter of request stating:
A few questions have been brought to my attention which I would like your opinion on. If a candidate or a candidate's wife is a notary public, can they notarize absentee ballots? Also, is the notary seal a requirement on the envelope containing the absentee ballot?"
The answer to your first question is "Yes", to your second "No", Section 23-9-409(c), Mississippi Code of 1972, stating in pertinent part:
"If one or the other officers (includes notaries public) herein named acts as attesting witness, his signature on the electors certificate, together with his title and address, but no seal shall be required. (Emphasis supplied.)
