Dear Mrs. Cole:

Attorney General Bill Allain has received your opinion request dated June 17, 1983, and has assigned it to me for research and reply, your letter of request stating:

"Mr. Jones was in Mrs. Martin's office to file for the coming election. She called and talked with R. N. Allen of their office who later called Bill Carter.

"It was verbally stated that there was no reason why he was not qualified by the Democratic Party to run whether he now lives at the Tchulahoma address or not.

"We met the night of June 14, 1983 at 7 P.M. This was stated to us at that time. May we have your advice as soon as possible in order to have the ballots printed if, in fact, this is your opinion that Mr. Jones may run for this office. Does he need to live there now to run for office? --for Justice Court Judge."

A qualification for public office is being a qualified elector of the district he or she offers to serve. We understand the candidate you refer to lives in another justice court district but is building a house in the district he wishes to serve and plans to move there as soon as the house is completed.

He must move his registration to his "new" district and his 30 days' residency requirement in the district must be 30 days prior to August 2, 1983, the date of the first primary.
