Re: Elections - Absentee Ballots

Bear Mrs. Waller:

Attorney General Allain has received your letter of request and has assigned it to me for research and reply.

Your letter states:

"This office would deeply appreciate an opinion on the following question:

"If Jane Doe filed an application for an absentee ballot in the first primary election or the second primary election, is she required to file another absentee ballot application for the November General Election?"

In response to your inquiry, it is the opinion of this office that a qualified elector who will be entitled to vote by absentee ballot in the November, 1983, General Election must file an application therefor regardless of whether said elector filed such application for either the first or second primary election.

Therefore, the answer to your question is "yes".

Very truly yours,

BILL ALLAIN, ATTORNEY GENERAL
