Dear Ms. Overstreet:

Attorney General Allain has received your letter of request and has assigned it to me for research and reply.

Your letter states:

"The question has come up as to the need to initial ballots when using voting machines.

"In your opinion, when using voting machines with ballot cards that have serially numbered stubbs, do these ballots have to be initialed in a primary, special, or general election."

In response to your request, please see the enclosed copies of opinions addressed to Mrs. Charlotte B. Williams, dated September 14, 1983, and Mr. Emmette P. Allen, dated September 9, 1975, respectively.

In summary, these opinions state that the initialing requirement is applicable only to primary elections and that even in primary elections said requirement does not apply to ballots used in connection with machine or electronic voting systems which have serially numbered stubbs.
