Dear Mr. Ainsworth:
v. Freeman-Howie, Inc., 239 Miss. 84, 121 So.2d 120 (1960), held that a municipal board of aldermen is a legislative body. Therefore, in response to your inquiry, while you may lawfully be a candidate for city alderman without resigning as county surveyor, you may not hold the two offices simultaneously
Very truly yours,
EDWIN LLOYD PITTMAN, ATTORNEY GENERAL
