Dear Mr. Thompson

Attorney General Edwin Lloyd Pittman has received your opinion request dated February 13, 1985, and has assigned it to me for research and reply. Your inquiry states:

I would appreciate very much an opinion from your office on the following question: "would county employee who is seeking a part time political office in a municipality need to a leave of absence from their position to seek that office and if elected, be able to keep their position in county government."

I am enclosing for your consideration copies of the official opinions of this office which relates to this matter. These opinions are to the Honorable Peter Halat, dated February 7, 1985, James E. Cofer, dated April 18, 1983 and Honorable H. Latrelle Ashley, dated April 12, 1983.

You do not give us sufficient information to enable us to determine whether or not the employee will be able to keep both positions if elected to municipal office. There may be a conflict of office which would prevent an individual from holding both positions.
