TEXT Honorable Herman Cockrell
Smith County Election Commissioner
Post Office Box 517

Dear Mr. Cockrell
Attorney General Edwin Lloyd Pittman has received your letter of request and has assigned it to me for research and reply. Your letter states:
I am an Election Commissioner of Smith County, Mississippi, and I have participated in the January 1987 meeting of the Election Commissioners for the purpose of purging the voter rolls of the County.
My question is, can I be a candidate for another office in the County in the upcoming election August 4, 1987.
Pursuant to Miss. Code Ann. 23-15-217 (Supp. 1986; Special Pamphlet), an election commissioner may not be a candidate for any office (other than election commissioner) at any election with reference to which he has acted as an election commissioner.
According to your letter, you participated in the first meeting of the election commission in 1987 as required by Miss. Code Ann. 23-15-157 (Supp. 1986; Special Pamphlet). Therefore, it is the opinion of this office, that you are disqualified from running for another office in the 1987 primary and general elections. Please find attached hereto an opinion to the Honorable Hubert S. Moore dated February 13, 1979, which is in accord with this opinion.
Should you have any questions or if we may be of further assistance, please do not hesitate to contact this office.
Sincerely,
EDWIN LLOYD PITTMAN, ATTORNEY GENERAL
