Attorney for Noxubee County Board of Supervisors

Re: Number of Poll Workers

Dear Mr. Hemphill:

Attorney General Mike Moore has received your letter of request and has assigned it to me for research and reply. Your letter states:

“I am writing as Board Attorney for the Noxubee County Board of Supervisors to request an opinion on the following issue dealing with elections:

How many election workers are required by law to be assigned to each voting table during a general election?”

In response to your question, Mississippi Code Annotated, Section 23-15-231 (Revised 1990) provides in part:

“Prior to every election, the commissioners of election shall appoint three (3) persons for each voting precinct to be managers of the election, ....” (emphasis ours)

Section 23-15-235 provides authority for the commissioners of election to appoint additional poll workers based on the number of registered voters in a particular precinct.

We do not find any statutory requirement as to how many workers are to be assigned to each “voting table”.

Sincerely,

Mike Moore, Attorney General.

Phil Carter, Assistant Attorney General.
