Dear Ms. Pearson:
Attorney General Mike Moore has received your request for an opinion and has assigned it to me for research and reply. Your letter asks:
What are the duties of the Jury Commissioners if a county is using an electronic system, according to law, to compile the master list of the voter registration, the jury wheel, and the selection of prospective jurors for each court term? If there are duties, how many days will they work?
In response the duties of the Jury Commission are described at Sections 13–5–8, 13–5–10, 13–5–12, 13–5–14 and 13–5–21 of the Mississippi Code . This list is not exhaustive. These duties include the duty to compile and maintain a master list consisting of the voter registration list, to maintain the jury wheel, to select numbers or names of jurors to place into the jury wheel, to send to the circuit judge the list of the names on the jury wheel, and other duties. However, the Jury Commission need not perform any clerical duties themselves but may delegate them to the circuit court clerk. This is in accord with a prior opinion of this office dated 4–15–81 to Jack Wiggins, copy attached. Of course, the Jury Commission would only work on days that they are actually performing some function of their office.
