Dear Mr. Williams:
Attorney General Summer has received your letter of inquiry and has assigned it to the undersigned for research and reply.
According to the provisions of Section 7–5–25, Mississippi Code of 1972, the Attorney General is not authorized to render official opinions to anyone other than certain designated State and local officials and to them only concerning the duties of their respective offices.
You state that you may become a candidate for Justice Court Judge and ask if a Justice Court Judge may also serve as an Alderman. The two offices to which you refer are not compatible and may not be held by one individual at the same time, due to the doctrine of separation of powers of government into three areas, which are executive, legislative and judicial.
