Re: Registrar's Compensation (Automated Registration)
Dear Ms. Hart:
Attorney General Mike Moore has received your letter of request and has assigned it to me for research and reply. Your letter states:
“Since an automated voter roll was not initially part of the circuit clerk's required (mandatory) job duties, and no specific statutory procedure in current law, can the circuit clerk be compensated for the work and time involved in completing this job, and how?â€
Please see the enclosed copy of an opinion addressed to Joe C. Griffin, Esquire, dated February 11, 1992. In summary that opinion states, inter alia, that the additional time and work required to establish the required automated voter registration system is a single, unique occurrence which was not contemplated at the time the salaries of registrars were originally enacted and expresses our opinion that a county board of supervisors would be authorized to approve a one time additional payment for the Registrar or some qualified individual designated by the Registrar for performing this task.
