Dear Mr. Bogue:
Attorney General Summer has received your letter of request dated January 16, 1979, and has assigned it to me for research and reply.
In your letter you inquire as follows:
‘I need an opinion on a matter relating to election of trustees of a consolidated school district.
A teacher in one of our consolidated districts is desirous of becoming a candidate in the March 3, 1979, election of trustees of that same consolidated district.
Since this person is an employee of the school district, would she be eligible to serve as trustee of that district?'
It is my understanding that the person to whom you refer will retire from teaching at the conclusion of this school year. If this is true, it is the opinion of this office that such person may seek the office of trustee of the school district and serve if elected.
However, if such person is not planning to terminate employment at the close of the school year of 1978–79, there would be no need to run, since he or she could not lawfully contract with the board of which he or she is a member.
