Dear Mr. May:

Attorney General Edwin Lloyd Pittman has received your request for an official opinion and has assigned it to me for research and reply. Because of the length of your inquiry, a copy is attached hereto and made a part of this opinion as if copied herein.

As attorney for the Newton County Board of Education you seek clarification of a recent opinion issued by this office concerning payment of costs incurred in school bond elections.

In an opinion addressed to Mr. W.M. McMullan dated September 24, 1986, this office was of the opinion that in view of the changes in Mississippi Code Annotated § 37-59-11, as amended by Chapter 492, Laws of 1986 (Mississippi Uniform School Law of 1986), the school board of the school district would pay costs incurred in a school bond election.

Even though no election was held, the cost of verifying signatures on the petition filed with the school board was an expense incurred and the Newton County Board of Education is obligated to pay for work performed by the Election Commissioners of Newton County in verifying signatures on the petition.
