Dear Ms. Simmons:
Attorney General Edwin Lloyd Pittman has received your letter of request and has assigned it to me for research and reply. In your letter you request an opinion as to the date upon which an election commissioner must resign his office in order to qualify for an elective office in the 1987 election year.
You will please find enclosed a copy of an opinion dated February 11, 1987, addressed to the Honorable Herman Cockrell wherein we state that an election commissioner may not be a candidate for any office (other than election commissioner) at any election with reference to which he has acted as an election commissioner. As you can see by the attached opinions, the annual purging meeting of the election commissioners has been determined to be a meeting in reference to the primary and general elections held in that particular year. We hope that these opinions will answer your questions.
