Dear Mr. Crosthwait:

Attorney General Edwin Lloyd Pittman has received your request for an official opinion from this office and has assigned it to me for research and reply.

As attorney for the Board of Trustees of the Indianola Municipal Separate School District you inquire as to whether there is an ethics question involved if an employed teacher of the district qualifies as a candidate for alderman of the City of Indianola.

The mere fact that an employed teacher of the municipal separate school district qualifies as a candidate for city alderman does not constitute a conflict of interest. See Atty. Gen. Op., Marion L. Hayes (June 8, 1979). However, both positions may not be held by the teacher.
