Dear Mr. Anderson:

Attorney General Mike Moore has received your letter of request and has assigned it to me for research and reply. In your letter you state:

This is in reference to our conversation by phone this date in reference to a petition. I need a written opinion concerning the signatures on a petition as to whether their name must appear exactly the same as they are registered to vote, or if we can identify them as a registered voter without the name appearing exactly as registered, in order to certify a petition. This question has been brought to our attention and there has been some confusion about it.

Pursuant to Miss. Code Ann. § 1-3-75 (1972), all petitions must be personally signed by each petitioner. It is the opinion of this office that so long as it may be determined that the signature on the petition is that of a qualified elector, it should be counted.
