Dear Mrs. Ryals-Blaylock:

Attorney General Mike Moore has received your letter of request and has assigned it to me for research and reply. In your letter you ask:

We have numerous request from voters requesting their names be removed from the poll books because of jury duty. Is it legal for a voter to remove his name from the poll books for this reason?

We have been unable to find any statutory authority for the removal of the name of a registered voter from the registration and poll books in order to avoid jury duty. Pursuant to Miss.Code Ann. § 23-15-153 (1987), the Commissioners of Election may remove from the registration and poll books the names of all persons erroneously thereon, who have died, removed or become disqualified as electors for any cause. It is the opinion of this office that these are the only reasons for which a person's name may be removed from the registration and poll books.
