Dear Mr. Stinson:
Attorney General Mike Moore has received your letter requesting an opinion of this office and has assigned it to me for research and reply.
Your letter requests an opinion on behalf of the Mayor of the Town of Tylertown on the question of whether an individual who is currently serving as an appointed member of the municipal election commission may be qualified as a candidate if she does or does not resign her office as election commissioner.
Under state law, a mayor does not exercise any duties with respect to candidates qualifying for municipal office. Under Section 7–5–25, Miss.Code Ann. (Supp.1988), this office is restricted to issuing official opinions to public officials on questions of law that relate to their respective offices. Accordingly, we must, respectfully, decline to respond with an official opinion.
