Dear Mr. Evans:
Attorney General Mike Moore has received your letter of request and has assigned it to me for research and reply. Your letter states:
“I am at present an elected alderman for the Town of DeKalb and have two (2) more years in office.
I would like to have an Attorney General's opinion in writing as follows:
I may qualify to run for Kemper County Supervisor and remain in office as alderman and if elected to the Board of Supervisors, then at that time, I must turn in my resignation as alderman for the Town of DeKalb.
I have a verbal opinion by phone and would like to have a legal opinion in writing, that I may qualify and remain in office as an alderman.â€
In response to your inquiry, we know of nothing that would prevent you from continuing to serve as a municipal alderman while being a candidate for the office of county supervisor.
