Elections - Qualifications to Vote
Dear Mr. Warren:
Attorney General Allain has received your letter of request and has assigned it to me for research and reply.
Your letter states:
“A voter registration applicant that will be 18 years of age before the general election and after the primary election; that meets all other requirements under Section 25-5-303, Mississippi Code of 1972, as amended, that registered at least 30 days prior to the primary election, does this qualify this applicant to vote in the primaries as well as the general election?
“When a qualified elector of the county moves from one precinct to another within the county and fails to transfer his registration 30 days prior to the election, where does the elector vote?â€
In response to your first question please see the enclosed copy of an opinion addressed to Honorable W. Rayford Jones, dated February 6, 1975. In summary that opinion states that one who is duly registered thirty days prior to the first primary and will be eighteen years of age on or before the date of the general election may vote in the primary and general elections if otherwise qualified.
In response to your second question, those persons who have moved to and resided in a new district in their county for thirty days or more are eligible to vote only in the district in which they now reside (the new district).
The transfer of registration within the county is not required to be done within thirty days of the election.
