Elections - Qualifications of Candidates
Dear Mrs. Mortimer:
Attorney General Allain has received your letter of request and has assigned it to me for research and reply.
Your letter states:
“The President of the Board of Supervisors has asked that I request a written opinion about how or when a person qualifies when our districts are subject to change by the Justice Department. Is it permissible for - for instance - an incumbent to go ahead and qualify in the district in which he now serves? Or for a person who has not served before to qualify in the district in which he now lives? Would he or she be required to pay an additional qualifying fee in the event their district is changed?â€
In response to your inquiry, it is the opinion of this office that one who has properly qualified as a candidate for a county district office would not be required to pay an additional qualifying fee in the event his / her district is changed before the election is held.
