Elections - Qualification of Candidates

Dear Mrs. Stevens:

Attorney General Allain has received your letter of request and has assigned it to me for research and reply.

Your letter states:

“As Circuit Clerk of Yalobusha County, I have been requested to write for your official opinion to the following question.

“Is a person eligible to run as an independent if he announced but did not officially qualify to run in the August primaries?

“I would be very grateful if you would respond promptly to this request, as the individual is waiting on your response before qualifying.”

In response to your question, we know of nothing which would prohibit one who announced but did not officially qualify to run in the August primaries from running as an independent.
