Re: Elections

Dear Judge Kopf:

Attorney General Allain has received your letter of request and has assigned it to me for research and reply.

Your letter states:

“I talked to you by phone two weeks ago about the Justice Court Judges of Tate County.

“The Justice Department passed on the district for Justice Court Judges as I understand.

“Please give me information on what steps to take for the General Election in November. Also, if there will be any second run off in this office.”

We assume that no primary elections for Justice Court Judges were held in Tate County.

In response to your inquiry, please see the enclosed copy of an opinion addressed to Honorable Thomas D. Kirschten, dated August 8, 1983.

In summary, that opinion states that the names of qualified individuals who have properly submitted petitions in accordance with Mississippi Code Annotated § 23-5-134 (Supp. 1982) requesting to be a candidate for Justice Court Judge must be placed on the November 8, 1983 General Election Ballot. It further states that, out of an abundance of caution, such petitions should be signed by not less than fifty (50) qualified electors of the appropriate Justice Court District since Section 23-5-134 does not prescribe a specific number of signatures for said office.
