Dear Ms. Craig:
Attorney General Edwin Lloyd Pittman has received your opinion request and has assigned it to me for research and reply, your letter of request stating:
“1. If my husband is a member of the County Executive Democratic Committee and I run again for Chancery Clerk, can be still serve during the time of my election or does he have to disqualify himself? Also, how would this apply to my son?
2. If a person is a member of the Democratic Executive Committee can he also serve as an elected Election Commissioner?â€
1. There is no requirement that a county candidate not have a relative on a party executive committee, although propriety might dictate that a relative's abstention from voting on matters affecting that relative.
2. The offices of party executive committee member and county election commissioner, however, are incompatible, since the Election Commission passes on certifications and other actions of the party executive committees.
