Re: Elections - Managers, Clerks and Bailiffs
Dear Mr. Bounds:
Attorney General Allain has received your letter of request and has assigned it to me for research and reply.
Your letter states:
“Please send this office a written opinion as to the minimum number of poll workers that are needed at each precinct to conduct the upcoming June Primary Elections.â€
In response to your inquiry, Mississippi Code Annotated § 3115 (1942) requires that the county executive committee shall appoint the managers for any primary election.
Mississippi Code Annotated § 23-5-99 (1972), as amended, requires that three (3) persons for each election district be appointed managers of the election.
Section 3116 (Code of 1942) requires that the managers of the election appoint two (2) clerks.
Section 23-5-105 (Code of 1972) requires the appointment of one (1) bailiff for each election district.
When there are two or more boxes in one precinct, each box shall have three (3) managers and two (2) clerks. However, there need be but one (1) bailiff for each precinct.
