Mississippi Attorney General Opinions

March 7, 1985

Alderman Jimmy Easley

Post Office Box 214

Duck Hill, Mississippi 38925

Municipal Officers

Dear Mr. Easley:

Attorney General Edwin Lloyd Pittman has received your letter of request and has assigned it to me for research and reply.

Your letter states:

“I am an Alderman for the Town of Duck Hill, Mississippi. We are now approaching the time for our town to have its election.

“Recently a question was raised with regard to a brother serving as our town mayor and his sister serving as an alderman. Since this issue needs to be resolved prior to the election, I would request you issue an opinion whether this would be prohibited under our state laws.

“Our elections are nearing so I would appreciate your contacting me as soon as possible.”

In response to your inquiry, we know of no prohibition against a brother and sister serving a Mississippi Municipality as mayor and alderman respectively.

Very truly yours,

Edwin Lloyd Pittman, Attorney General.
