Re: upon7-5-25, School Board Elections

Dear Mr. Jones:

Attorney General Allain has received your letter of request dated July 14, 1981. Your inquiry states as follows: Please enclose in your reply the latest information available concerning the proposed change in the time of the local school board elections. Is it true that the election time is to be changed from March to November?

Will you also indicate the exact time of the school board election for this year. Thank you very much for your expected cooperation.

The Legislature has limited this office to issuing legal opinions only to those public officials designated in Miss. Code Ann. Section 7-5-25 (Supp. 1980). Although we are unable to issue an official legal opinion, we are providing some information that may be helpful.

It is difficult to respond to your inquiry as your letter does not specify what type of school district you are referencing, that is, a countywide district, a municipal separate school district with added territory, a special municipal separate school district or a consolidated school district. The only changes which occurred in the election of school board trustees with the 1981 Legislature that we are aware of resulted from Senate Bill 2189 which will take effect after it is approved by the U. S. Justice Department under Section 5 of the Voting Rights Act of 1965. We are attaching a copy of this bill for your benefit.

If this office can be of service in the future, please do not hesitate to contact us.

Sincerely,

BILL ALLAIN, ATTORNEY GENERAL
